Criminal charges have been field against five South Winneshiek students.
18-year-old Braxton Smith on Tuesday was charged in adult court with aggravated assault with intent to commit sexual assault. The charge followed an investigation by the Winneshiek County Sheriff's Office.
According to the criminal complaint, the report by the Winneshiek County Sheriff's Office concluded that a sexual assault occurred in June of last year at a home on 180th Street, west of Spillville. The report states "the victim was held down against his will, the victim's shorts were pulled down, exposing his bare butt. The victim was not allowed to get up and the victim was telling the suspects to stop."
The report further states that dog treats were placed on the victim's bare butt and a dog at the home was allowed to eat the treats. The report concludes, "The incident was recorded by another juvenile on his cell phone using the Snapchat application and sent to other Snapchat users."
Four additional juveniles were referred to juvenile court. Due to public information laws, the Sheriff's Office is not able to release any additional details pertaining to the four juveniles.
The Winneshiek County Attorney's Office turned over the prosecution of this case to the Allamakee County Attorney's Office due to a conflict of interest.
