District Court Judge Linda Fangman has approved a defense motion to dismiss one of the two charges filed against Brian Fullhart of Cresco, who is accused of causing the death of Decorah native Zoanne Fullhart last March.
The judge dismissed without prejudice a charge of Going Armed With Intent, but the charge of Murder in the First Degree remains and Fullhart's trial has begun. Jury selection took place Wednesday, with prosecution witnesses testifying starting at 9:00 a.m. Thursday. decorahnews.com will cover the trial.
The charge of Going Armed with Intent was filed in connection with the armed stand-off which took place after Cresco Police were called to the scene of Fullhart's home on March 1st of 2018. The charge of First Degree Murder was filed in connection with the death of Brian Fullhart's wife, Zoanne.
The murder trial is being prosecuted by Special Assistant State Attorney General Scott Brown and Howard County Attorney Kevin Schoeberl, while Matthew Hoffey is the attorney for Brian Fullhart.
