First degree murder trial of Decorah native Brian Fullhart has been moved to July

Posted: Tue, Apr 23, 2019 11:51 AM

A continuance has been granted at the request of Decorah native Brian Fullhart, who is charged with First Degree Murder and Going Armed with Intent to Harm in connection with the death of his wife, 34-year-old Zoanne Fullhart of Decorah, in March of 2018 in Cresco.

Fullhart's attorney filed a motion earlier in April asking Judge Linda Fangman to postpone the trial scheduled for May 6th due to the unavailability of an expert witness. The prosecuting attorneys—Assistant Iowa Attorney General Scott Brown and Howard County Attorney Kevin Schoeberl— filed an opposing motion stating "The State is ready to try the case."

On Monday, Judge Linda Fangman ordered a continuance because a witness is unavailable. A speedy trial has been waived.

A jury trial is now scheduled for July 17th at 9:00 a.m. with a final pretrial conference scheduled for July 1st by phone.
