Probable cause has been ruled for a South Winneshiek graduate to stand trial on charges of Assault with Intent to Commit Sexual Abuse

Winneshiek County Magistrate Nathaniel Moonen presided over a Sunday afternoon court appearance by 18-year-old Braxton Smith, one of five people facing charges in connection with an incident last June at a home on 180th Street, west of Spillville.
A criminal complaint was filed and a copy was given to Smith. Moonen then determined that there is probable cause to believe that an offense has been committed and the defendant committed it.
The other four defendants in the case are minors, so they will be appearing in Juvenile Court, whose records are not open to the public.
No date has been set yet for Smith's trial on the charge of aggravated assault with intent to commit sexual assault.
