Jury trial scheduled for September of two Ossian residents facing drug charges

Ossian residents Kaleb and Cole Breitsprecher will go on trial on drug charges in US District Court in Cedar Rapids in September.

The two brothers, ages 22 and 24, respectively, appeared in court again on Tuesday afternoon in Cedar Rapids.  September 18th has been set as the date of their trial. 

The indictment alleges Kaleb Breitsprecher distributed heroin to another person on or about April 5th, April 18th and May 19th.  Kaleb has been indicted on three counts of distribution of a controlled substance (heroin)  and one count of possession of firearms by a drug user.   If convicted on all charges, Kaleb Breitsphrecher faces a maximum sentence of 70 years in prison, $3.25 million in fines and up to a lifetime term of supervised release if released from prison.  Kaleb remains in custody in jail at Cedar Rapids.

The indictment also alleges that on or about May 2nd, Cole Breitsprecher distributed fentanyl to another person.  Cole has been indicted on one count of distribution of a controlled substance (fentanyl) and one count of possession of firearms by a drug user. Cole Breitsprecher faces a maximum sentence of 30 years in prison, $1.25 million in fines and a lifetime term of supervised release if released from prison.  Cole has been released pending his trial.

The two men will be back in court in August for hearings on defense motions.
