The City of Iowa City is asking a judge to throw out the lawsuit filed over the "Kinnick House"

The City of Iowa City wants Reed and Sandy Carlson of Decorah to be able to proceed with their plans to build a house that's a replica of Kinnick Stadium.

The controversial proposal resulted in a 2-2 tie vote by the Iowa City Board of Adjustment this fall on a motion to disallow construction--meaning the Carlsons could go ahead with their plan.

But the Manville Heights neighborhood association immediately filed a request in Johnson County court, asking declaratory judgment action for a permanent injunction against the construction.  On Friday both the neighborhood association and the City of Iowa City filed arguments with the judge in the case, in support or opposition to Iowa City's motion to have the case thrown out of court.

No date has been set for a ruling by the judge.  If he rejects the City of Iowa City's motion, the case would go to trial.
