Battle over "Kinnick-style" house in Iowa City now is going to District Court

The battle between Decorah residents Reed and Sandy Carlson, who want to build a house on Lusk Avenue in Iowa City, and the neighbors of their property, who say the house is a "party house" that does not fit into the neighborhood, is now going to court.

The neighbors had formed the "Manville Heights Association" to fight against the City of Iowa City for issuing a building permit for the planned 7,500 square foot large house.  Their appeal to the Iowa City Board of Adjustment lost earlier on a 2-2 tie vote.

Now the group has filed a lawsuit in Johnson County District Court.  They are asking a judge to rule that the Board of Adjustment and the City of Iowa City acted wrongly when they classified the house as a single-family home and issued a building permit.

No date has been set yet for a hearing.
