The defense attorney in the Alex Fazzino murder trial, William Kutmus, pointed to the differing medical opinions in the case about the cause of Emily Fazzino's death.
In one and a half hours of closing remarks, Kutmus pointed to the prosecution's medical experts and said they agreed a cause of death couldn't be determined. "You just don't know" why Emily Fazzino died on January 29th, 2012, Kutmus said.
"The prosecution in this case is flat out wrong," he stated and said their case rested entirely on circumstantial evidence. Kutmus characterized the prosecution's case as "a lot of ifs, a lot of speculation."
Kutmus also returned to the issue of Emily Fazzino's addiction to painkillers and her use of alcohol. A Facetime video taken January 19th shows Emily under the influence of alcohol, Kutmus said. He accused the prosecution of having "tunnel vision" and not seeing Emily's problems.
Kutmus said there are "too many unknowns" in the case and asked jurors not to make guesses about what had happened. The burden of proof, he reminded jurors, rests with the prosecution, which must prove its case "beyond a reasonable doubt."
