What will the Fazzino jury be instructed?

Up to nine men and six women selected to hear arguments in the Alex Fazzino murder trial will begin deliberations soon--probably on Monday.  12 of the 15 Winneshiek County residents will be named as full jurors, with the other three being named alternates.

After the prosecution and defense make their closing arguments in the case, the jurors will be told to begin deliberations.

Here is what State of Iowa law says about a first degree murder charge:

"700.1  Murder In The First Degree - Premeditation, Willfulness, Deliberation - Elements.  The State must prove all of the following elements of Murder In The First Degree:

  1.  On or about the _____ day of __________, ____, the defendant __________ the victim.

  2.  The victim died as a result of being __________.

  3.  The defendant acted with malice aforethought.

  4.  The defendant acted willfully, deliberately, premeditatedly and with a specific intent to kill the victim.

If the State has proved all of the elements, the defendant is guilty of Murder In The First Degree.  If the State has failed to prove any one of the elements, the defendant is not guilty of Murder In The First Degree."
