The Iowa Court of Appeals has overturned an Allamakee County court ruling in a case involving Associated Milk Producers.
Allamakee County resident Virgil Johnson and Virgil Johnson Trucking had filed a petition claiming that Associated Milk Products, Inc. had breached its contract with them to pay specific sums for delivering milk to AMPI's plant in Arlington.
AMPI countered that the original contract had been modified or replaced beginning September 1st of 2013 and that all sums due had been paid in full.
But Johnson, who was represented by Decorah attorney John Anderson, appealed the ruling of District Court Judge Margaret Lingreen.
The Iowa Court of Appeals earlier this week reversed that decision and sent the case back to District Court. Justices ruled that the original judgment "was not appropriate."
