It's possible that a Winneshiek County jury won't hear evidence in the Alexander Fazzino murder case until next year after a judge agreed to delay the trial for a fifth time.
Fazzino faces life in prison if he is convicted of first-degree murder in the death of his wife, Emily, whose body was found in the bathtub of the family's home in Boone in January of 2012.
In April of 2013 Fazzino was arrested on the first degree murder charges and a trial was set for September of 2013. Fazzino's attorney filed a number of motions to delay the trial, including a motion this year to delay the trial while his daughter underwent a bone marrow transplant.
Now Fazzino's attorney, William Kutmus of Des Moines, has asked for another delay for more time to analyze evidence in the case.
Prosecutors opposed the request, saying that with conflicts in September, October and November, as well as the Christmas holiday, the trial would have to be rescheduled for January 2016 or later.
ts in September, October and November, as well as the Christmas holiday, would likely mean trial would have to be rescheduled for January 2016 or later.
District Court Judge Michael Moon ruled in favor of Fazzino earlier this month and now has scheduled a court session at 10:00 a.m. Monday to select a new date for the trial. The trial was moved to Decorah because of pre-trial publicity. Judge Moon confirmed that the trial still will be held in Decorah.
