Mr. Answer Person addresses the legality of fireworks in Iowa

David e-mails Mr. Answer Person: "If I want to light some fireworks on July 4th for family and friends, do I need a permit?"

Mr. Answer Person says: "Yes.  You might have heard that the Iowa legislature this year was talking about legalizing the use of some fireworks--but the legislature didn't take any action on the matter.  That means state law is still the same as it has been for a long time--you could get ticketed for shooting off fireworks.

Here's what state law says, " The term "fireworks" includes any explosive composition, or combination of explosive substances, or article prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration, or detonation, and includes blank cartridges, firecrackers, torpedoes, skyrockets, roman candles, or other fireworks of like construction."  Under the law, sparklers are exempted.  The law goes on to state: " A person, firm, partnership, or corporation who offers for sale, exposes for sale, sells at retail, or uses or explodes any fireworks, commits a simple misdemeanor.  In addition to any other penalties, the punishment imposed for a violation of this section shall include assessment of a fine of not less than $250."
