County Zoning Office rules no violations in June 5th barn dance

County Zoning Administrator Tony Phillips has ruled that no violations of the Winneshiek County zoning ordinances occurred at a June 5th barn dance at the Jim Dotzenrod farm at 1583 Canoe Ridge Road.

Chimney Rocks Campground owner Deb Keefe had filed a formal complaint with the Winneshiek County Attorney's Office and the Winneshiek County Zoning Department, contending that Dotzenrod should have gotten a conditional use permit for the event

In a June 17th letter to Keefe, Phillips says "No temporary facilities were constructed that would have required a conditional use permit."  Phillips noted that no buildings on Dotzenrod's farm were remodeled--which would have required a Construction Compliance Certificate, if done.

Furthermore, Phillips ruled the barn dance "was clearly incidental to the permitted use of the property and did not involve the conduct of business."  No admission was charged for the dance and no donations were solicited.

The Zoning Office has closed its investigation into the allegations of a barn dance being held without permits.
