The criminal case against 24-year-old Daniel Wildman of Cresco has now shifted to U.S. District Court in Cedar Rapids.
Wildman made a court appearance at 4:30 Monday afternoon on two charges relating to the unlawful possession of firearms. One charge was that Wildman possessed firearms after being convicted of a felony, while the second charge claimed that Wildman possessed firearms and used marijuana. Wildman has been detained pending a detention and preliminary hearing scheduled for Thursday, August 1st at 4:30 pm in Cedar Rapids.
In the criminal complaint filed in Cedar Rapids, Winneshiek County Deputy Tim Felton says he applied for a search warrant October 16th last year and then searched the shed where Wildman had been hiding. Felton's affidavit says the search found one 9 millimeter gun; one Remington 12-gauge shotgun; multiple rounds of 9mm ammunition; three marijuana pipes; .22 caliber ammunition; and two spent 12 gauge shotgun shells, among other items.
Judge Jon Stuart Scoles of the U.S. District Court has ruled that probably cause exists to believe Wildman possessed one or more firearms on October 16th, in violation of the law.
On Tuesday Winneshiek County prosecutors will go to court to ask for dismissal of the Winneshiek County charges filed against Wildman, so that the double jeopardy issue is not relevant. From here on out, Wildman should face only the federal charges.
