Cresco social worker and substance counselor Gilbert Alber testified in court Thursday that he was told by accused attempted murderer Daniel Wildman that Wildman had used $1,000 a week of oxycontin for the past year.
That statement led Alber to declare in court that Wildman was "addicted to oxycodone."
Wildman's defense attorney, Mark Anderson of Cresco, is attempting to prove that Wildman's drug use made it impossible to knowingly waive his rights and give a confession to shooting a rifle at three people in Calmar.
But when asked by County Attorney Andy Van der Maaten whether Wildman's drug use prevented him from knowingly waiving his rights, Alber said "I can't answer that." And Alber also admitted his conclusions about Wildman were based on a one hour in-person interview and the review of tapes made of Wildman during his arrest.
Judge John Bauercamper is being asked to suppress evidence in Wildman's case, including his confession.
