Christina Gray's attorney, Heather M. Kingery, has e-mailed the following Letter to the Editor in response to our story http://www.decorahnews.com/news-stories/2013/04/5237.html last week about her client:
"Ms. Gray's March 2012 criminal conviction for Theft against Linda Henning was largely affected by the inadequate representation of the legal counsel assigned to her, David Strand, who was disbarred by the Iowa Supreme Court in 2012 of which Ms. Gray is currently looking into appealing her wrongful conviction.
Linda Henning went on to sue her in civil court for the same promissory note along with interest, attorney fees, and punitive damages for allegedly committing fraudulent misrepresentation for indicating to Linda Henning that Ms. Gray has had a history of cancer along with other severe chronic illnesses.
In fact, in the Response to Plaintiff Henning's Motion for Summary Judgment, Ms. Gray presented medical evidence of a history of cancer as an exhibit for the Court's review. The Court declared in its ruling on which Ms. Gray prevailed on the Motion for Summary Judgment that, "...the Court cannot say, as a matter of law, any act of theft or fraudulent practice committed by Defendant also constitutes fraudulent misrepresentation. The Court does not find Henning entitled to judgment as matter of law on her fraudulent misrepresentation claim". The parties later came to an agreed upon settlement of which the Court accepted. Ms. Gray was not found guilty by the Court, but rather agreed through the attorneys to a settlement.
Linda Henning's conduct toward Ms. Gray over the course over the last year has cause significant and severe emotional distress in Henning continuing to perpetuate false rumors about Ms. Gray."
